Agreement to Terms

By accessing or using the PushFire platform ("Service"), operated by PushFire ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including users of our web console, APIs, SDKs, and any associated documentation or tools.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Definitions

• "Service" refers to the PushFire platform, including the web console at console.pushfire.app, all APIs, SDKs, documentation, and related tools and services.
• "User," "you," or "your" refers to any individual or entity that accesses or uses the Service.
• "Account" refers to the user account you create to access the Service.
• "Content" refers to push notification messages, images, data, and any other materials you create, upload, or transmit through the Service.
• "End User" refers to recipients of push notifications sent through the Service.
• "Subscription" refers to the paid plan you select to access certain features of the Service.

Account Registration and Security

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. If you are creating an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

Description of Service

PushFire provides a visual platform for creating, managing, and automating push notification workflows. The Service includes:

• A web-based console for designing push notification flows
• APIs and SDKs for integrating push notifications into your applications
• Analytics and reporting tools for monitoring notification performance
• Automation tools for scheduling and triggering notifications based on user behavior or events

We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that affect your use of the Service.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Send push notifications that contain spam, phishing attempts, malware, or other harmful content
• Use the Service to harass, abuse, or send unsolicited messages to individuals who have not opted in to receive notifications
• Violate any applicable laws, regulations, or third-party rights, including privacy and data protection laws
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems connected to the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to collect or store personal data of End Users in violation of applicable privacy laws
• Resell, sublicense, or redistribute the Service without our prior written consent
• Exceed the rate limits or usage quotas associated with your Subscription plan
• Send notifications with misleading or deceptive content

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending accounts, and reporting violations to law enforcement authorities.

Push Notification Compliance

You are solely responsible for ensuring that your use of push notifications complies with all applicable laws and regulations, including but not limited to:

• Obtaining proper consent from End Users before sending push notifications
• Providing End Users with a clear and accessible way to opt out of receiving notifications
• Complying with platform-specific guidelines from Apple (APNs), Google (FCM), and other push notification services
• Adhering to applicable data protection regulations such as GDPR, CCPA, and CAN-SPAM

You must maintain accurate records of End User consent and make them available upon our reasonable request.

Subscription Plans and Billing

Access to certain features of the Service requires a paid Subscription. By selecting a Subscription plan, you agree to pay the applicable fees as described on our pricing page.

• Billing Cycle: Subscriptions are billed on a monthly or annual basis, depending on the plan you select.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• Price Changes: We may change Subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
• Taxes: You are responsible for any applicable taxes associated with your Subscription.
• Failed Payments: If a payment fails, we may suspend access to paid features until the outstanding balance is resolved.

Cancellation and Refunds

You may cancel your Subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle, and you will retain access to paid features until that date.

We do not provide refunds for partial billing periods or unused portions of a Subscription. If you believe you are entitled to a refund due to a billing error, please contact us at support@pushfire.com within 30 days of the charge.

We reserve the right to cancel or suspend your Subscription if you violate these Terms.
